1. General

These Terms and Conditions apply to all sales agreements concluded between LaKo Trade Oy (Business ID: FI20177954, hereinafter referred to as the "Service Provider") and the customer of the Suomikauppa.fi online store (hereinafter referred to as the "Customer"). These agreements are made through the Suomikauppa.fi online store (hereinafter referred to as the "Online Store") operated by the Service Provider.

By placing an order through the Online Store, the Customer accepts these Terms and Conditions and agrees to comply with them.

The Service Provider reserves the right to amend these Terms and Conditions by publishing an updated version in the Online Store. The version of the Terms and Conditions in force at the time of placing an order shall apply to that order.

3. Using the Online Store and Personal Data

To place an order, the Customer must provide a valid email address, telephone number and any other information requested by the Online Store. The Customer is responsible for ensuring that all information provided is accurate and kept up to date.

The Online Store processes Customers' personal data as the data controller in accordance with applicable data protection legislation.

When the Customer places an order or otherwise provides an email address to the Online Store, that email address may be associated with a customer profile or customer account. Customers can sign in by verifying ownership of their email address using either a one time verification code or a sign in link sent by email. No separate registration or password is required.

Suomikauppa.fi may send service messages relating to product reviews through its chosen review platform following a purchase.

4. Ordering

Products are ordered by adding them to the shopping cart and completing the checkout process. Before placing an order, Customers are encouraged to review the contents of their shopping cart, delivery details and selected shipping method.

The Customer's order becomes binding once the Customer confirms the order and completes payment through the Online Store. An automatic order confirmation acknowledging receipt of the order will then be sent to the email address provided by the Customer.

A binding sales agreement between the Customer and the Service Provider is formed only once the Service Provider has accepted the order. The Service Provider reserves the right, for justified reasons, to refuse an order or any part of an order. If an order cannot be fulfilled in whole or in part due to, for example, product availability, pricing errors, export or import restrictions or any other justified reason, the Service Provider will notify the Customer and refund the amount paid for any unavailable products using the original payment method.

The Service Provider reserves the right to limit order quantities and to refuse or cancel orders where there is reasonable suspicion of misuse, payment default, fraudulent activity or any other justified reason.

 

5. Product Availability

The Online Store aims to provide accurate and up to date information about its products but cannot guarantee the accuracy of all information or the continuous availability of products. Some products are seasonal items and are available only in limited quantities. Products displayed in the Online Store may also be temporarily out of stock or sold out.

Product availability displayed in the Online Store or shopping cart may change before or after payment has been completed. If, after an order has been received, it becomes apparent that the Online Store is unable to supply a product, the Customer will be refunded the full purchase price of the unavailable product.

 

6. Prices

Unless otherwise stated, all prices displayed in the Online Store are shown in euros (EUR). For orders delivered to Sweden, Canada, the United States, the United Kingdom and Japan, prices may also be displayed in the local currency. The applicable currency will be shown before the order is placed.

Prices for products delivered within the European Union include the applicable VAT of the destination country.

For orders delivered outside the European Union, the recipient is generally responsible for any local taxes, customs duties, import charges and other fees imposed by the destination country, unless otherwise stated in the Online Store or at checkout.

For orders delivered to the United States, any applicable customs duties are collected at checkout. These charges are itemised before the order is confirmed and will not be charged again upon delivery.

Shipping costs are displayed separately before the Customer confirms the order.

The Service Provider reserves the right to change prices. Price changes do not affect orders that have already been accepted.

If the Online Store contains an obvious and material pricing, calculation or product information error, the Service Provider shall not be obliged to supply the product based on the incorrect information.

 

7. Payment

The Customer may pay for an order using any payment method made available in the Online Store. Available payment methods may vary depending on the destination country, currency, order contents and technical availability.

The Online Store may offer, for example, online bank payments, payment cards, mobile payment methods, digital wallets, invoice and instalment payment services, and other electronic payment methods. Payments are processed through the Service Provider's authorised payment service providers.

Where payment is made using credit, invoice or instalment options, the terms and conditions of the relevant payment service provider shall apply, including any provisions relating to creditworthiness assessments.

The total order amount is charged using the payment method selected by the Customer at the time the order is placed. If the Customer chooses to pay by bank transfer, the order will be processed only after the payment has been received by the Service Provider. The Customer is responsible for any bank charges associated with the payment.

Discount codes and promotional codes may be accepted in accordance with their respective terms and conditions. Such codes may apply only to specific products, product categories, shipping costs or orders and cannot be combined with other offers unless expressly stated otherwise.

The Service Provider reserves the right to reject a payment transaction or the use of a discount code where there is a justified reason to do so, including technical errors, suspected misuse or use contrary to the applicable terms.

 

8. Delivery

The Service Provider delivers products to almost every country worldwide through its available shipping partners. Available shipping methods may vary depending on the destination country, shipment size and order contents.

Delivery time consists of the order processing time and the transit time. Orders are typically processed within 1–3 business days of receipt. Transit time depends on the selected shipping method and the destination country. Delivery times shown in the Online Store are estimates only and are not guaranteed. Any time required for customs clearance is not included in the estimated delivery times.

Once an order has been prepared for dispatch, the Service Provider will send the Customer a shipping confirmation by email together with a tracking link or tracking number. The progress of the shipment can then be monitored using the carrier's tracking service.

Orders containing fresh bakery products are processed according to a separate shipping schedule. Fresh bakery orders are dispatched in accordance with the schedule published in the Online Store. DHL Express and FedEx Priority are recommended for orders containing fresh bakery products. The Service Provider is not responsible for any deterioration in product quality where the Customer selects a shipping method other than the recommended option for fresh products.

The Customer is responsible for providing a delivery address where the recipient can be reached during delivery and for ensuring that all delivery information is accurate. Any additional costs resulting from incorrect or incomplete delivery information may be charged to the Customer.

The Service Provider aims to dispatch all products in a single shipment but reserves the right to split an order into multiple shipments where necessary.

The Customer is responsible for ensuring that the contents of an order comply with the import regulations, restrictions and other official requirements of the destination country. The Service Provider reserves the right to remove products from an order where export or import is prohibited by applicable legislation, official regulations or carrier restrictions. In such cases, the purchase price of the removed products will be refunded.

For orders delivered to the United States, any applicable customs duties and other official charges are collected at checkout and itemised before the order is confirmed. For deliveries to countries outside the European Union, other than the United States, the recipient is responsible for any applicable local taxes, customs duties, import charges and other official fees.

If a shipment is returned to the Service Provider because it was not collected, the recipient could not be reached or incorrect delivery details were provided, the Service Provider reserves the right to deduct the actual shipping, return and handling costs from any refund due to the Customer.

The Customer may add Shipping Protection to an order at checkout. Shipping Protection is an optional service provided by the Service Provider that offers an extended compensation policy for certain issues that may arise during transit. The scope of coverage, eligibility for compensation, limitations and all other terms are governed by the Shipping Protection Terms in force at the time. If a delivery is delayed, damaged or otherwise affected by a problem during transit, the Customer must contact the Service Provider's customer service without undue delay.

 

9. Gift Cards

Electronic gift cards are available for purchase through the Online Store. Gift cards are available in denominations of €35, €50, €75, €100, €150 and €200.

Gift cards are purchased through the Online Store in the same way as any other product.

Gift cards are delivered electronically. The Customer may choose to receive the gift card at the email address provided during checkout or have it sent directly to the recipient using the gift option available in the Online Store.

Where the Customer chooses to send the gift card as a gift, it will be delivered to the recipient's email address on the delivery date selected by the Customer or, if no delivery date has been specified, as soon as reasonably practicable after payment has been accepted.

The Customer is responsible for ensuring that the recipient's email address and any other information provided when purchasing the gift card are accurate.

Gift cards are valid for 365 days from the date of purchase. Any unused balance remaining after the expiry date will not be refunded.

Gift cards may be used as a payment method in the Suomikauppa.fi Online Store. They may be redeemed in one or more transactions during their validity period.

If the value of an order exceeds the available gift card balance, the Customer must pay the remaining amount using one of the payment methods available in the Online Store. If the order value is lower than the available gift card balance, the remaining balance will remain available for future purchases until the gift card expires.

Gift cards are sold in euros (EUR). Depending on the Customer's location or selected market, gift card prices may also be displayed in another currency. In such cases, currency conversion is based on the exchange rate applied by the Online Store at the time of purchase.

Where a gift card is redeemed in a currency other than euros, its value is converted using the exchange rate applicable at the time of redemption. Exchange rate fluctuations may affect the value of the remaining balance when viewed in other currencies.

Gift cards cannot be redeemed for cash, and any unused balance will not be paid out in cash unless required by mandatory applicable law.

The Service Provider is not responsible for gift cards that are lost, delivered to an incorrect email address or used without authorisation after the gift card has been delivered to the Customer or to the recipient designated by the Customer.

 

10. Cancellations and Returns

10.1 Cancellation before dispatch

The Customer may cancel an order at any time before it has been dispatched. Cancellation requests must be submitted without undue delay either through the Service Provider's customer service or via the cancellation function available in the Online Store. The Customer must verify their identity using the same email address that was used to place the order. The Service Provider will acknowledge receipt of the cancellation request without undue delay.

Where an order contains fresh bakery products, those products may be cancelled until Thursday at 12:00 (EET) preceding the relevant Monday dispatch. After this deadline, fresh bakery products can no longer be removed from the order.

10.2 Exercising the right of withdrawal after dispatch

Once an order has been dispatched, consumer Customers have the right to withdraw from the purchase within 14 days of receiving the goods in accordance with the Finnish Consumer Protection Act, unless the product is exempt from the statutory right of withdrawal.

To exercise the right of withdrawal, the Customer must submit a notice of withdrawal before returning the product. The notice may be submitted through customer service or via the returns function available in the Online Store. The Customer must verify their identity using the same email address that was used to place the order. The Service Provider will acknowledge receipt of the notice of withdrawal without undue delay.

The statutory right of withdrawal does not apply to products that are liable to deteriorate or expire rapidly, including fresh bakery products sold through the Online Store.

Returned products must be sent back to the Service Provider no later than 14 days after the notice of withdrawal has been submitted.

Returned products must be in substantially the same condition as when received, remain suitable for resale and, where reasonably possible, be returned in their original packaging. The Customer must be able to provide proof of purchase, such as an order confirmation or receipt, if requested.

If a returned product has been handled beyond what is necessary to establish its nature, characteristics and functioning, the Customer is liable for any resulting reduction in the product's value in accordance with the Finnish Consumer Protection Act.

Products cannot be exchanged. If the Customer wishes to receive a different product, the original product must be returned in accordance with these Terms and Conditions and a new order must be placed. The new order will be charged at the prices in force at the time it is placed.

Unless otherwise required by mandatory law or expressly agreed by the Service Provider, the Customer is responsible for the cost of returning products under the right of withdrawal.

The Service Provider will refund all payments received for a validly cancelled order using the same payment method used for the original transaction unless otherwise agreed. Refunds will be made without undue delay and no later than 14 days after the Service Provider has received the notice of withdrawal. However, the Service Provider may withhold the refund until the returned product has been received or the Customer has provided reliable evidence of having returned it, whichever occurs first.

Returning goods or refusing to accept delivery without first submitting a notice of withdrawal does not constitute a valid exercise of the right of withdrawal.

If a shipment is returned to the Service Provider because it was not collected and the Customer has not exercised their right of withdrawal, the Service Provider reserves the right to deduct the actual shipping, return and handling costs from any refund due.

Gift cards cannot be returned or redeemed for cash once they have been delivered to the Customer or to the recipient designated by the Customer.

 

11. Product Inspection and Complaints

The Service Provider is liable for defects in products in accordance with the applicable legislation in force from time to time.

The Customer must inspect the delivery without undue delay after receipt and verify that it contains the ordered products and that the products are free from visible defects or damage.

If the Customer discovers a defect, shortage or damage in the delivery or the products, the Customer must notify the Service Provider without undue delay by contacting customer service at info@suomikauppa.fi or by submitting a claim through the online claim form. Products that are the subject of a claim must be retained until the claim has been resolved or returned to the Service Provider in accordance with the instructions provided.

To facilitate the handling of a complaint, the Customer may be asked to provide photographs of the product, its packaging, any transport damage and any other information reasonably required to assess the claim.

The Service Provider is not responsible for any deterioration in quality or damage resulting from the Customer selecting a shipping method that is unsuitable for the product's shelf life or transportation requirements, providing incorrect delivery information or failing to store the product appropriately after delivery.

Fresh bakery products must be accepted without undue delay and stored in accordance with the storage instructions provided with the product. The Service Provider is not responsible for any deterioration in quality resulting from the Customer selecting a shipping method other than the recommended option for fresh products or failing to store the product correctly after delivery.

The Service Provider is not responsible for any deterioration in the quality of temperature sensitive products, such as chocolate, including melting, or for any deterioration in the quality of other products caused by weather conditions or by the Customer's failure to receive or store the products appropriately after delivery.

Where a complaint is accepted, the Service Provider will, as appropriate, repair the defect, replace the product, refund the purchase price or provide another remedy in accordance with the applicable consumer protection legislation.

 

12. Force Majeure

The Service Provider shall not be liable for any delay, failure to deliver or other failure to perform its contractual obligations where such failure is caused by circumstances beyond the Service Provider's reasonable control, including force majeure.

 

13. Governing Law and Jurisdiction

These Terms and Conditions and all agreements concluded through the Online Store shall be governed by the laws of Finland, excluding its conflict of laws provisions, unless otherwise required by the mandatory laws of the Customer's country of residence.

The parties shall seek to resolve any disputes primarily through negotiation.

If a dispute cannot be resolved through negotiation, it may be submitted to the District Court of Helsinki, Finland. However, consumer Customers are also entitled to bring proceedings before the competent court or other competent consumer dispute resolution body in their country of residence where required by applicable law.

Consumers resident in Finland may also refer a dispute to the Finnish Consumer Disputes Board (Kuluttajariitalautakunta). Before doing so, consumers are encouraged to contact the Finnish Consumer Advisory Services (Kuluttajaneuvonta).
